STUDENT ENROLMENT AND SERVICE AGREEMENT OF PSYSIUM EDUCATIONAL SERVICES
Effective from January 1, 2020
This Student Enrolment and Service Agreement (“Agreement”) is a legal contract between PSYSIUM
EDUCATIONAL SERVICES, also operating as PSYSIUM ACADEMY and PSYSIUM (“Psysium”, “we”, “us”,
“our”), and each person who accesses or uses our online coaching services, Recorded sessions, classes, test series, and study material (“Student”, “you”, “your”). By registering for or using any of our Services, you
acknowledge that you have read, understood, and agree to be bound by this Agreement and by the
terms and policies published on our official website and communication channels from time to time.
1. Definitions
1.1 “Psysium”, “Institution”, “we”, “us”, “our” means PSYSIUM EDUCATIONAL SERVICES, also known
as PSYSIUM ACADEMY and PSYSIUM, including its owners, directors, employees, mentors, educators
and authorised affiliates.
1.2 “Student”, “you”, “your”, “user”, “client” means any natural or legal person who accesses the
Website, purchases or uses any Services, registers for a course or test series, or accesses any study
material provided by Psysium.
1.3 “Website” or “Platform” means Psysium’s official online platform, website, mobile site, learning
management system or application through which we deliver classes, test series and resources.
1.4 “Services” means all educational and related services offered by Psysium, including but not limited
to online live or recorded classes, mentoring, doubt-clearing sessions, test series, question banks, and
academic support.
1.5 “Material” or “Resources” means any content provided by us in any format, including printed
notes, books, PDFs, e-books, hand-outs, mock tests, test series, question papers, presentations, audio
or video lectures, online classes and any other documents or files shared with you.1.6 “Study Material Order” means any order where the primary product is printed or digital study
material, with or without an associated test series.
1.7 “Coaching Classes” means our live or recorded online classroom programmes, including any
associated access to recordings, class notes and internal forums.
1.8 “Test Series” means online or offline tests, mock exams and associated analytics or explanations
provided for a limited period.
1.9 “Device” means a single physical device, such as a mobile phone, tablet or laptop, which you
register with us for accessing the Platform.
2. Scope and Acceptance
2.1 This Agreement governs your use of our Website, Services and all Material made available to you.
By creating an account, paying fees, accessing any classes or Materials, or clicking any “I agree”,
“Register”, “Pay Now” or similar button, you accept this Agreement electronically and consent to be
bound by it.
2.2 If you are under eighteen (18) years of age, you represent that you are using the Services with the
consent and supervision of a parent or legal guardian, and that such parent or guardian has accepted
this Agreement on your behalf.
2.3 If you are acting on behalf of an organisation or institution, you represent that you are authorised
to bind such entity to this Agreement.
3. Intellectual Property and Permitted Use
3.1 All Material and content are the exclusive intellectual property of Psysium or its licensors and are
protected under the Copyright Act, 1957, the Information Technology Act, 2000 and other applicable
Indian laws, together with any amendments or successor legislation.
3.2 Your enrolment provides you with a limited, personal, non-exclusive, non-transferable, revocable
licence to use the Material solely for your own learning and exam preparation during the validity
period specified for your course or test series.
3.3 You shall not, without our prior written consent, copy, reproduce, scan, re-record, screen-record,
photograph, distribute, sell, resell, lend, lease, license, publish, upload, share, broadcast or otherwise
make any Material available to any third party, whether free of cost or for consideration, in any
format (digital or physical).
3.4 Any form of commercial use, resale, or unauthorised sharing of Material or login credentials is
strictly prohibited and constitutes copyright infringement and breach of this Agreement.
3.5 To deter piracy, we may include unique identifiers or codes (including alphanumeric codes, visible
or invisible watermarks or similar features) on or within Material associated with your account. You
agree that such identifiers may be used to trace and evidence unauthorised distribution or misuse.
4. Single-Student Licence, Account Sharing and Group Use
4.1 Each enrolment with PSYSIUM EDUCATIONAL SERVICES / PSYSIUM ACADEMY / PSYSIUM is strictly
personal to one individual Student. The Services and all Material are licensed for the exclusive use of
that Student only.
4.2 The Student shall not permit any other person to access the Services or Material through their
account. This includes but is not limited to sharing login credentials, using screen-sharing, projecting
or playing classes in any group setting (online or offline), or allowing friends, relatives, other coaching
centres or third parties to study from the Student’s account.4.3 Any such use shall be treated as unauthorised sublicensing and a material breach of this
Agreement, entitling Psysium to immediate suspension or termination of access without refund,
together with damages and other remedies as provided in this Agreement and under applicable law.
4.4 Where Psysium has reason to suspect such sharing or group use, Psysium may immediately
suspend or restrict the Student’s access to their account and all Services for the duration of an
internal investigation. The Student accepts that no refund, extension or alternative access will be
provided for the period of such suspension, whether or not the suspicion is ultimately confirmed.
5. User Account, Credentials, Device Restrictions and Responsibility
5.1 You must provide accurate and complete information at the time of registration, including your
full name, valid mobile number, email address and any other information we reasonably require.
5.2 You are responsible for maintaining the confidentiality of your login ID, password and any one-
time passwords (OTPs). You must not share your login credentials with any other person, even if they
are a family member or friend.
5.3 Your account is strictly personal. Any evidence of sharing of passwords, simultaneous logins from
multiple devices that are inconsistent with normal personal use, or other indications of misuse may
be treated as a material breach of this Agreement.
5.4 You may access the Platform and classes through only one Device registered with us at the time of
joining. Device-swapping is not permitted except in the limited circumstances set out in this
Agreement.5.5 If your registered Device is stolen or permanently lost, you must report the incident to law- enforcement authorities and provide us with a copy of the FIR or official complaint. On receipt of
satisfactory proof, we may, at our discretion, update your account to a new Device.
5.6 If your Device is under repair or temporarily not working, you may request a temporary change of
Device. We may, at our discretion, allow access from one alternate Device for up to seven days once
during your course period. After that, you must revert to your original Device.
5.7 You agree that we may monitor login and logout sessions, IP addresses, Device details and general
location information (city or state level, not precise geolocation) strictly for security, anti-piracy and
fraud-prevention purposes, in accordance with applicable data protection laws.
5.8 The Student is solely responsible for all activity that occurs through their account, whether or not
such activity is expressly authorized by the Student. Except where the Student has notified Psysium in
writing of suspected unauthorized access within twenty-four (24) hours of first becoming aware of it
and has fully cooperated in any subsequent investigation, all access, streaming, downloading, viewing
or sharing of Material through the Student’s account shall be conclusively presumed to have been
carried out by, or with the knowledge and consent of, the Student.
5.9 Failure to promptly inform Psysium of any suspected misuse or compromise of the account shall
itself constitute a material breach of this Agreement. In any case where such misuse or compromise is
alleged or suspected, Psysium may, in its sole discretion, place the account under review and
temporarily disable access to classes, test series and Materials until its investigation is completed. The
Student agrees that no refund, extension of validity or substitute access will be owed for the time
during which the account remains under such suspension.
6. Course Access, Validity and Watch Limits
6.1 Unless otherwise stated in your specific course details, access to Coaching Classes (live or
recorded) is valid for one year from the course commencement date. The commencement date will be the date of the first scheduled class for that batch or the date on which access to recorded content
is first granted, whichever is earlier.
6.2 After the expiry of the validity period, your access to classrooms and recordings will automatically
lapse and related content may be permanently deleted or archived from our servers. You will not be
entitled to any extension unless expressly confirmed in writing by Psysium.
6.3 Once a course has commenced or access to recorded lectures has been granted, you shall not be
entitled to pause, suspend, defer or otherwise alter the validity period. Your validity runs
continuously, irrespective of whether you access or utilize the course, in full or in part. Non-usage or
partial usage will not entitle you to any extension, credit or refund.
6.4 Unless otherwise indicated in your specific course terms, each recorded lecture can typically be
viewed a maximum of two times. For this purpose, one “view” will mean watching at least seventy
per cent of the total duration of that recording. Merely opening and closing a recording without
substantially viewing it shall not be counted as a full view.
6.5 Psysium may provide limited buffer watch-time (for example, an additional ten minutes per
recording) to allow for pausing and resuming. The exact calculation or configuration may be updated
by us to account for technical constraints and will be reflected in your course interface.
6.6 If you exceed the permitted view limits or watch time, we reserve the right to charge an additional
streaming fee as described in this Agreement, and/or to restrict access to further content, suspend or
terminate your account, depending on the severity and frequency of the breach. The additional fee will be charged at the rate of 100 INR per additional hour of watch time.
6.7 Unless separately mentioned, access to any Test Series, whether standalone or bundled with
classes or study material, will be valid for one year from the date the test series access is first granted.
After that date, access may be withdrawn without notice and without any refund.
7. Fees, Payments and Partial Payments
7.1 The fees for each course, test series or Study Material Order will be as displayed on our Website
or in our official communication at the time of purchase. All amounts are payable in Indian Rupees,
inclusive or exclusive of taxes as specified.
7.2 Your enrolment will be confirmed only after we receive the required payment in full or as per the
payment plan expressly allowed by us.
7.3 If we permit partial or instalment-based payment for a course, you must pay the balance amount
within thirty (30) days from the start of classes, unless a different schedule is specifically
communicated in writing.
7.4 If you fail to pay the remaining amount within the stipulated time, we may suspend your account
and revoke all related Services until the dues are cleared. In such cases, no refund will be issued for
any amount already paid.
7.5 We reserve the right to change fee structures or introduce new charges for new batches or future
offerings. Such changes will not affect fees already paid for a confirmed enrolment, except where
required by law.
8. Cancellations, Refunds, Transfers, Extensions and Credits
8.1 General Refund Policy
Except as expressly provided in this Clause 8 or required by applicable law, all fees paid to Psysium are final and non-refundable. Enrolment, payment, non-attendance, non-usage, partial usage, dissatisfaction with teaching style, change of mind, personal circumstances, examination postponement, failure to qualify an examination or failure to obtain a desired score, rank, admission or other outcome shall not create any right to a refund, credit, transfer, deferment, validity extension or compensation.
All refund, cancellation, transfer, deferment, credit, replacement and extension requests shall be governed by this Clause 8, even where refund-related consequences are also mentioned elsewhere in this Agreement.
8.2 Study Material Orders
A Student may request cancellation of a printed or physical Study Material Order within twenty-four (24) hours of placing the order, provided that the order has not already been dispatched or processed beyond cancellation. Where cancellation is approved, ninety per cent (90%) of the total amount paid will be refunded, and ten per cent (10%) will be retained toward administrative and processing expenses.
Once physical study material has been dispatched, no monetary refund will be provided. If the material is not delivered or the parcel is lost, the Student must notify Psysium within twenty (20) days from the date on which the tracking details or dispatch confirmation were communicated. Claims submitted after this period may be rejected, except where applicable law requires otherwise.
Where printed material contains a genuine printing or manufacturing defect, the Student must report the defect within a reasonable period and provide clear photographic or video evidence. If Psysium verifies the defect, a replacement copy may be provided without additional charge, and the defective material may be collected or required to be returned. The decision as to whether the reported issue qualifies as a printing or manufacturing defect shall be reasonably determined by Psysium.
No refund will be provided after physical study material has been delivered. Digital study material is non-refundable once access has been granted, the material has been opened, viewed or downloaded, except where a mandatory statutory right applies.
8.3 Coaching Classes
Fees paid for live classes, recorded classes, hybrid classes, mentoring programmes, doubt-clearing services, academic-support programmes or any other Coaching Classes are non-refundable once access to any live session, recording, classroom, resource or associated Service has been granted.
No refund will be provided because of non-attendance, irregular attendance, failure to view recordings, partial course completion, lack of preparation, dissatisfaction with teaching style, personal scheduling difficulties, technical limitations attributable to the Student, change of mind or a decision to discontinue preparation. Where early access to recordings, classes, study material, tests or other resources is provided before the official commencement of the Student’s batch, such access shall be treated as commencement of the Service. The Student shall not subsequently claim a refund on the ground that the official batch had not formally commenced.
8.4 Recorded Courses and Watch Limits
Recorded-course fees are non-refundable once access has been activated or any recording has been made available. Failure to watch recordings, expiry of course validity, exhaustion of the permitted number of views, exhaustion of watch time or failure to complete the recordings within the validity period shall not entitle the Student to a refund, extension, additional viewing time, replacement access or credit.
Where the Student exceeds the permitted view or watch-time limits, Psysium may restrict further access or charge an additional streaming fee in accordance with the applicable course terms. Payment of an additional streaming fee shall not extend the original course-validity period unless Psysium expressly confirms otherwise in writing.
8.5 Test Series
Fees paid for any Test Series, mock examination, question bank, analytics service or associated explanation are non-refundable once access has been granted. This rule applies whether the Test Series was purchased separately or was bundled with Coaching Classes, study material or another Service. Non-usage, partial usage, failure to attempt tests, expiry of access or dissatisfaction with test scores or explanations shall not entitle the Student to a refund, extension, replacement or credit.
8.6 Course Validity and Non-Usage
Course and Test Series validity shall run continuously from the applicable commencement date and shall not be paused, suspended or extended because the Student did not use, partially used or temporarily could not use the Services. The expiry of course validity, deletion or archival of recordings, personal unavailability, illness, travel, employment, academic commitments, examination delays or other individual circumstances shall not create a right to a refund, transfer, deferment, credit or extension unless Psysium expressly approves an exception in writing.
8.7 Course, Batch and Section Allocation
Psysium may combine compatible sections, reallocate Students between sections, modify section strength, change class schedules or permit Students from related programmes to attend common classes or modules where academically and operationally appropriate. A change in section size, batch allocation, educator, schedule, delivery arrangement or combination of compatible classes shall not, by itself, entitle the Student to a refund, transfer, extension, credit or compensation, provided that the substantive Services of the Student’s enrolled programme continue to be delivered.
8.8 Transfers, Deferments and Course Changes
Enrolment is personal and ordinarily cannot be transferred to another person, course, batch or academic session. No Student shall have an automatic right to transfer, defer, pause or convert an enrolment. Any course transfer, batch transfer, deferment, adjustment or conversion may be permitted only at Psysium’s discretion and must be confirmed in writing. Approval of one exceptional request shall not create a precedent or obligation to approve similar requests in the future. Where a transfer or adjustment is approved, Psysium may impose reasonable administrative conditions, account for Services already accessed and require payment of any applicable fee difference.
8.9 Partial and Instalment Payments
Where Psysium permits partial or instalment-based payment, amounts already paid are non-refundable once access to any part of the Services has been granted. Failure to pay the remaining balance within the stipulated period may result in suspension or termination of access. Such suspension or termination shall not entitle the Student to a refund of any amount already paid, nor shall it cancel the Student’s obligation to pay any outstanding amount lawfully due.
8.10 Device Changes and Technical Issues
Temporary inability to access the Services because of loss, repair, replacement or malfunction of the Student’s Device shall not create a right to a refund, extension or alternative access, except for any limited Device-change facility expressly permitted under this Agreement. Psysium will make reasonable efforts to address verified technical problems attributable to its Platform. Temporary interruptions, maintenance, internet-service issues, third-party platform interruptions or technical problems attributable to the Student’s Device, connection or software shall not ordinarily entitle the Student to a refund.
8.11 Student Support and Response Delays
Student-support facilities may be available twenty-four (24) hours a day, seven (7) days a week for the submission of queries. This does not guarantee an immediate or real-time response.
Delays caused by query volume, complexity, educator availability, holidays, technical difficulties or operational circumstances shall not entitle the Student to a refund, extension, credit or compensation, provided that Psysium continues to make reasonable efforts to respond and deliver the substantive Services included in the enrolled programme.
8.12 Suspension During Investigation
Where Psysium reasonably suspects account sharing, piracy, unauthorised group use, security circumvention, misuse of Material or another material breach, it may temporarily suspend or restrict access while conducting an investigation.
If the investigation confirms a material breach, the Student shall not be entitled to any refund, extension, credit, replacement access or compensation for the period of suspension or for any resulting termination.
If the investigation does not establish a breach by the Student, Psysium shall restore access and may provide a reasonable extension corresponding to any material period during which access was unavailable.
8.13 Termination for Breach
Where access is suspended or terminated because of account sharing, unauthorised use, piracy, copyright infringement, non-payment, misconduct, abuse of staff or Students, violation of Device restrictions, security interference or any other material breach of this Agreement, no refund, transfer, credit, extension or compensation shall be provided.
Termination without refund shall be without prejudice to Psysium’s right to recover outstanding fees, additional streaming charges, reasonable compensation, legal costs or any other remedy available under applicable law.
8.14 Examination Results and Selection
Taking, attending or completing Psysium’s classes, Test Series, mentoring, study material or other Services does not guarantee qualification, selection, admission, rank, score, employment or any particular academic or professional outcome. The Student’s examination performance depends on several factors beyond Psysium’s control, including preparation, effort, consistency, attendance, revision, competition, cut-off marks, eligibility, reservation policies, seat availability and examination or institutional requirements. Failure to obtain the expected result shall not entitle the Student to a refund, credit, compensation, transfer or extension.
8.15 Refunds Initiated by Psysium
If Psysium cancels a paid Service and does not provide a substantially equivalent replacement, alternative batch, credit or other reasonable arrangement, Psysium may provide an appropriate refund for the undelivered portion of the Service, subject to applicable law and after accounting for any Services or Materials already provided. No refund shall be required where a class is rescheduled, an educator is replaced, compatible sections are combined or reasonable changes are made to the mode, timing or administration of the Service without materially withdrawing the enrolled programme.
8.16 Approved Refunds
Any refund approved under this Clause shall ordinarily be returned through the original payment method or another method reasonably selected by Psysium. Applicable payment-gateway fees, bank charges or administrative deductions may be deducted where permitted by law and clearly communicated to the Student. Processing time may depend on banks, payment gateways and other third-party service providers. Psysium shall not be responsible for delays occurring after an approved refund has been released to the relevant payment processor or financial institution.
8.17 Exceptional Requests
Psysium may, at its sole discretion, approve an exceptional refund, credit, extension, transfer or adjustment on compassionate, administrative or commercial grounds. Any such approval shall be voluntary, case-specific and without admission of liability.
An exception granted to one Student shall not create a contractual right, precedent or entitlement for any other Student or for the same Student in a future matter.
8.18 Statutory Rights and Precedence
Nothing in this Clause is intended to exclude or restrict any consumer right that cannot lawfully be waived or excluded under applicable Indian law.
If any refund-related statement elsewhere in this Agreement conflicts with this Clause 8, this Clause 8 shall prevail to the extent of the inconsistency. All references elsewhere in the Agreement to termination without refund, suspension without extension, non-refundable fees or similar consequences shall be read together with this Clause and applicable law.
9. Student Conduct and Morality Clause
9.1 You agree that you will use the Website and Services for lawful purposes only and will not engage
in any conduct that is illegal, unethical, defamatory, abusive, harassing, obscene, discriminatory or
otherwise harmful to the reputation, goodwill or legitimate interests of Psysium, its staff or other
students.
9.2 You will not use the name PSYSIUM EDUCATIONAL SERVICES, PSYSIUM ACADEMY, PSYSIUM or any
associated logo, brand, trademarks or goodwill in any manner that is misleading, derogatory or likely
to cause confusion among the public, including on social media, messaging platforms or public
forums.
9.3 If, in our reasonable opinion, you commit any act or omission which could be considered immoral,
deceptive, scandalous, obscene or likely to damage our reputation or goodwill, we may immediately
terminate your access to the Services without any refund and may seek appropriate legal remedies.
10. Data Collection, Monitoring and Privacy
10.1 In order to provide and secure the Services, prevent piracy and comply with law, we may collect
and process certain personal data, including your name, contact details, course details, Device
identifiers, IP address, general location (city or state level), login sessions, course progress data and
payment information.
10.2 We will handle your personal data in accordance with applicable Indian law, including the
Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, together with
rules and notifications issued thereunder, as updated from time to time.
10.3 We use such data for lawful purposes including account creation and management, delivery of
classes and tests, technical support, anti-piracy and fraud detection, security monitoring, analytics to
improve our services, compliance with legal obligations and enforcement of this Agreement.
10.4 We may share your personal data with trusted third-party service providers (such as payment
gateways, video-hosting platforms, cloud service providers and communication tools) strictly on a
need-to-know basis and under appropriate contractual safeguards. We may also disclose data to law-
enforcement or regulatory authorities if required by law or for the protection of our legal rights.
10.5 By using our Services, you consent to such collection and processing of your personal data and
acknowledge that you have read and understood our privacy notices as published on our Website.
11. Breach, Investigations, Suspension, Termination and Penalties
11.1 Any of the following shall be treated as a material breach of this Agreement:
(a) Sharing of login credentials or unauthorised simultaneous logins on multiple devices beyond what
is reasonably expected for personal use.
(b) Copying, recording, re-uploading, distributing or otherwise sharing our Material contrary to
Clauses 3, 4 and 5.
(c) Attempting to bypass, disable or tamper with digital rights management, watermarks or technical
protection measures.
(d) Exceeding the permitted Device or view limits deliberately or on a repeated basis after we have
notified you.
(e) Non-payment of amounts due, including course fees, instalments or additional streaming charges.
(f) Serious misconduct or behaviour that falls within the Morality Clause in Clause 9.
(g) Any breach of a separate non-disclosure or confidentiality agreement you may have entered with
us.
11.2 If any classes, recordings, tests, notes or other Material of Psysium are found, in whole or in
substantial part, on any third-party platform, channel or storage (including but not limited to
Telegram groups, WhatsApp groups, Google Drive links, YouTube channels, other websites or
coaching centres) in a form that reasonably corresponds to the courses or Materials accessed by the
Student, such appearance shall, to the fullest extent permitted by Indian law, be treated as primafacie and rebuttable evidence that the Student has disclosed, or has allowed others to disclose, such
Material in breach of this Agreement. Each such leakage or platform where the Material appears shall
be treated as a separate breach.
11.3 Without prejudice to Psysium’s rights under the Copyright Act, 1957, the Information Technology Act, 2000 and other applicable laws, a Student who breaches Clauses 3, 4, 5, 6 or any applicable confidentiality obligation may be liable to pay reasonable compensation or liquidated damages of up to INR 100,000 for each established breach, subject to the nature of the breach, the loss caused and the amount lawfully recoverable under applicable law. Psysium may also seek injunctive relief, recovery of legal costs and any other remedy available from a court of competent jurisdiction.
11.4 Where an investigation confirms a material breach, no refund, extension or substitute access will be provided for the period of suspension. Where the investigation does not establish a breach by the Student, Psysium will restore access and provide a reasonable extension corresponding to any material period during which access was suspended.
11.5 For excess use of streaming services beyond the permitted limits clearly communicated for your
course, Psysium may charge an additional streaming fee at the rate notified on the Website at that
time, which may, for example, be INR 100 for each block of sixty (60) minutes of excess watch time.
You agree to pay such charges promptly upon receipt of an invoice or notification. Repeated refusal to
pay such charges may result in suspension or termination of your account.
11.6 Duty to identify co-users and cooperate in anti-piracy action: In addition to any other obligations,
the Student agrees to fully cooperate with Psysium in investigating any suspected unauthorised
sharing or piracy of the Services or Material. Such cooperation shall include, upon reasonable request,
providing truthful information about any person to whom the Student has given access to their
account or Material, identifying any groups or channels where the Material has been shared,
preserving and sharing screenshots, chat records or other evidence, and, if required, providing
statements or testimony in any legal proceedings initiated by Psysium. Refusal to cooperate,
providing false information or attempting to conceal the identity of co-users or group administrators
shall itself be deemed a serious and independent breach of this Agreement, entitling Psysium to
terminate Services without refund and to seek damages and other legal remedies. The Studentunderstands and agrees that, during any such investigation, Psysium may suspend or restrict access to
the Student’s account, classes, Test Series and Materials, and that such suspension will remain in
force until the investigation is completed or closed, without any obligation on Psysium to grant a
refund, extension of validity or substitute access for the duration of the suspension.
11.7 In the event of a breach, Psysium may, at its sole discretion and without prejudice to any other
rights or remedies available in law or equity, do one or more of the following: suspend or
permanently revoke your access to some or all Services without refund; demand payment of
outstanding amounts including course fees, streaming charges and liquidated damages; initiate civil
and/or criminal proceedings under applicable laws; cooperate with law-enforcement authorities,
including sharing necessary logs and data subject to law; and seek injunctive relief or any other
appropriate order from a court of competent jurisdiction.
12. Student Support
12.1 Psysium provides student-support facilities twenty-four (24) hours a day, seven (7) days a week, through the communication channels designated by Psysium. Students may submit academic doubts, examination-related queries, technical concerns and general course-support requests at any time.
12.2 Availability of twenty-four-hour support means that Students may send queries at any time; it does not guarantee an immediate or real-time response. Replies may occasionally be delayed because of the volume of queries, the complexity of the issue, educator availability, holidays, technical problems or other operational circumstances. Psysium will make reasonable efforts to respond within an appropriate period.
12.3 Students must communicate respectfully and provide complete and relevant information when submitting a query. Repeated messages regarding the same issue, abusive conduct or misuse of support channels may result in the query being deprioritised or the Student’s access to support being restricted.
12.4 Psysium may determine the appropriate mode, timing and personnel for responding to a query. Student support does not include guaranteed one-to-one mentoring, immediate educator availability or assistance unrelated to the Student’s enrolled course, unless expressly included in the applicable course description.
12.5 Psysium may modify the support channels, procedures or response arrangements where reasonably necessary, without affecting the Student’s access to the substantive Services included in their enrolled programme.
13. Use of Name, Photograph and Exam Results
13.1 The Student expressly agrees that if they qualify an examination, secure a notable rank, obtain
admission to an institution or otherwise achieve a significant academic outcome while enrolled with
PSYSIUM EDUCATIONAL SERVICES / PSYSIUM ACADEMY / PSYSIUM, Psysium may, for bona fide
academic, informational and marketing purposes, display and publish the Student’s name,
photograph, city, course name, qualifying examination, year of qualification, rank or other public
result details on its Website, printed brochures, banners, posters, internal presentations and official
social media and communication channels, including but not limited to YouTube, Instagram,
Facebook, Telegram, WhatsApp and similar platforms.
13.2 The Student shall have no objection to such fair and accurate use of their name, image and result
details and agrees that no separate fee or compensation will be payable by Psysium for such use.
Where the Student is a minor, this consent and no-objection is deemed to have been given by the
parent or legal guardian who has accepted this Agreement on the Student’s behalf.
13.3 The Student or their parent/guardian may, however, at any time request in writing that Psysium
cease using their photograph and name for future marketing materials, in which case Psysium will act
on such request within a reasonable time for new and ongoing digital content. This shall not require
Psysium to recall or destroy any print or digital material already created, printed or lawfully published
prior to receipt of such request.
14. No Guarantee of Results and Limitation of Liability
14.1 While Psysium strives to provide high-quality educational content and support, it does not
guarantee any particular exam results, scores, ranks, admissions, jobs or outcomes. Your performance
depends on many factors, including your own effort and circumstances, which are beyond Psysium’s
control.
14.2 To the fullest extent permitted by law, Psysium’s total aggregate liability to you for any and all
claims arising out of or in connection with this Agreement or the Services, whether in contract, tort
(including negligence) or otherwise, shall not exceed the total fees actually paid by you to Psysium for
the specific course or product that is the subject of the claim.
14.3 Psysium shall not, under any circumstances, be liable for any indirect, incidental, consequential,
punitive or special damages, including but not limited to loss of opportunity, loss of data or loss of
expected exam outcomes, even if Psysium has been advised of the possibility of such damages.
14.4 Enrolment in, attendance at, or completion of any course, class, test series, mentoring programme or other Service offered by Psysium does not guarantee that the Student will qualify any examination, obtain a particular score or rank, secure admission, receive an interview call, gain employment or achieve any other academic or professional outcome.
14.5 Examination performance and selection depend on several factors beyond Psysium’s control, including the Student’s preparation, effort, consistency, attendance, revision, examination performance, eligibility, competition, cut-off marks, seat availability, reservation policies, institutional requirements and changes in examination patterns or selection procedures. Accordingly, Psysium does not provide any assurance, promise, representation or guarantee of qualification, selection, admission, rank, score or employment.
15. Severability
15.1 Each clause and sub-clause of this Agreement is independent and severable. If any provision is
held to be invalid, illegal or unenforceable in whole or in part by a court or other competent
authority, such invalidity, illegality or unenforceability shall not affect the validity or enforceability of
the remaining provisions, which shall continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 This Agreement shall be governed by and construed in accordance with the laws of India,
without regard to its conflict-of-law principles.
16.2 Subject to any mandatory dispute-resolution mechanism under applicable law, you agree that all
disputes, claims or controversies arising out of or relating to this Agreement or the Services shall be
subject to the exclusive jurisdiction of the courts of Patiala district, Punjab, India. You expressly waive
any objection to such jurisdiction on grounds of inconvenience or otherwise.
17. Amendments and Entire Agreement
17.1 Psysium may update, modify or amend this Agreement and related policies from time to time.
Any changes will be effective when posted on our Website or communicated to you through
reasonable means. Your continued use of the Services after such changes constitutes your acceptance
of the revised Agreement.
17.2 This Agreement, together with any course-specific terms, payment schedules, privacy notices
and additional policies referenced herein or published on our Website, constitutes the entire
agreement between you and Psysium regarding the Services and supersedes all prior or
contemporaneous communications, representations or agreements, whether oral or written.
18. Digital Acceptance and Signature
18.1 You acknowledge that you have read and understood the terms and conditions, including the
clauses on intellectual property, single-student licence, account sharing, device restrictions, validity,
non-refundability, data processing, investigations, penalties and jurisdiction, and that you agree to be
legally bound by them.
